Over two and a half years ago, on Sept. 9, 2010, just two days before the ninth anniversary of the Muslim terrorist attack of Sept. 11, 2001, I filed suit in the Supreme Court of the State of New York (Manhattan Division) on behalf of a brave first responder who was seriously wounded that tragic day. Vincent Forras, one of many heroes who rushed to save and comfort the wounded and dying, was himself buried under the rubble for a while. As a result of the toxic fumes and other poisons released into the air as a result of the attack, “Vinnie,” as his friends call him, was poisoned, so much so that he has to take 23 medications just to prolong his life expectancy, which is now very limited. He now runs a foundation called Gear Up, which assists firemen and other first responders throughout the United States and the world.
The complaint I filed on Vinnie’s behalf did not attack Muslims or Islam, but simply largely plead that the construction of a mosque at Ground Zero would constitute a nuisance to the neighborhood, as it would create a magnet for other terrorist acts, be a burden to New York City taxpayers, given the heightened and costly security issues it posed, and inflict emotional distress on the inhabitants as it would be a grim reminder of that fateful day. Indeed, almost 70 percent of New Yorkers agreed with this assessment, according to polls at the time, and thus a large majority of the Big Apple opposed its construction.
That, of course, did not stop our “mullah in chief,” President Barack Hussein Obama, and his lefty sidekick, the “nanny mayor” of New York City, Michael Bloomberg, from endorsing the Ground Zero mosque and its then imam, Feisal Abdul Rauf. Obama even had the chutzpah to praise it on a day he was feasting the Muslim holiday of Ramadan in the White House, his having canceled just days before a celebration of the National Day of Prayer there.
While Obama is at the very least a Muslim at heart, Bloomberg is, incredibly, a Jew. Their praise of the Ground Zero mosque and Imam Rauf, who I had sued along with the mosque, stood in stark contrast to a sworn affidavit that would later be filed by the attorney for the mosque and Rauf. His name is Adam Leitman Bailey; the mosque and the imam had obviously hired him because as a Jew he could seem freer and have more so-called “credibility” to attack Vinnie and me, who are also Jewish. In his affidavit, which he attached to a motion to dismiss our complaint, Bailey, on behalf of Rauf, attacked Vinnie and me viciously. Here is what he said to the court and the Muslim and non-Muslim world:
“As a lawyer I cannot to tolerate the destruction of the American Constitution at the hands of those who had been pledged to defend it. I will not let the right to prayer in the manner one chooses be silenced by shouts of rage: I will not let the right to free exercise of religion be confined by narrowness of vision; and I will not let the right to erect a house of prayer be torn down by blind bigotry.
“Ground Zero is a scar upon the landscape at the altar of international fanaticism, but because it allows bigotry like that of Plaintiff in this suit to flourish in the rich mud of ignorance and religious intolerance. The diversity of America is not its weakness, but its strength. When in the days following an analogous atrocity in 1941 our people marshaled their will and marched off, nobody was an American of this type or that. We are all united under a single banner pledged to eradicate the very kind of religious intolerance we see in Plaintiff, represented in those years by the Third Reich and those aligned with it. …
“It is therefore out of the most profound personal feelings as well as professional duty that I offer this Affirmation in support of the motion to dismiss this atrocity of a lawsuit.”
Bailey, having filed this strategically bigoted ad hominem attack on Vinnie and me in court, then proceeded to give it to the New York Post and other media for publication. His accusing us of being Nazis and bigoted toward Islam on behalf of a Muslim cleric was tantamount to issuing a “fatwah” against us, similar to what had been done by Iranian imams to famous author Salman Rushdie. In short, this outrage by a fellow Jew on behalf of Imam Rauf placed and continues to put Vinnie’s and my lives in danger.
In response to this “fatwah,” I asked the judge assigned to the case, Justice Lucy Billings, to sanction Bailey and the imam for inciting violence if not death against us. But the judge, a former lawyer for the ACLU and not coincidentally a jurist who had no problem with Occupy Wall Street trashing New York City’s Zuccotii Park in a later court ruling in another of her cases, refused to act and sanction Bailey and Rauf.
To make matters worse, Justice Billings, as has been the case of many leftist jurists in the last several years, sat on Vinnie’s lawsuit for over two years before finally dismissing it on bogus grounds Nov. 28, 2012, after Obama, perhaps not coincidentally, had been safely re-elected. The case is now on appeal.
During the course of the oral arguments in support of their motion to dismiss, the Ground Zero mosque and Imam Rauf, through Bailey, argued that the construction of the mosque would not create a nuisance since it was outside of the zone of Ground Zero. Notwithstanding that the Ground Zero mosque is only a block and a half away from the fallen World Trade Center Towers, the argument was absurd.
Just in the last days, however, New York City authorities discovered the landing gear of one of the Boeing 767 planes that hit the World Trade Towers in the backyard of the Ground Zero mosque at 51 Park Place. It would appear, based on the circumstances, that the developers and the imams of the mosque have been hiding it for 12 years.
It comes as no surprise that Bailey and his Muslim cleric client lied to the court. For this they will hopefully pay a price, as I am moving that they both be held in contempt for their deceit.
There is apparently no “honor among thieves” – or, for that matter, compromised leftist Jewish attorneys, Muslim imams and former ACLU lawyers turned judges, who desecrate the memory of those who died on September 11, pervert the rule of law and attempt to deny justice to our fallen heroes and our nation.
