Whereas, Barack Obama has nominated to the U.S. Supreme Court Elena Kagan, an attorney-activist with absolutely no prior judicial experience;
Whereas, Kagan has argued for extending presidential authority over regulatory matters in ways unsupported by the U.S. Constitution;
Whereas, Kagan, as dean of the Harvard Law School, banned military recruiting on campus because of the congressionally approved "don't ask, don't tell" policy on homosexuality, characterizing the policy implemented by former President Clinton as "a profound wrong – a moral injustice of the first order," and personally pursuing the issue all the way to the Supreme Court where justices unanimously rejected her arguments;
Whereas, Kagan has praised "socialism's greatness," writing that "In our own times, a coherent socialist movement is nowhere to be found in the United States";
Whereas, Kagan takes an extremist pro-abortion position, even having created a task force in the Department of Justice and a grand jury to investigate peaceful pro-life activists;
Whereas, Kagan served as a paid adviser to Goldman Sachs, an investment firm that profited off the misery of millions of Americans hurt by the sub-prime mortgage crisis;
Whereas, Kagan is an advocate of the use of foreign-law precedents in shaping United States Supreme Court rulings and, as solicitor general promoted the use of foreign-law arguments before the court;
