Radical changes transform compensation claims landscape
PR Log - Apr 22, 2013 - VICTIMS of road accidents this month will be among the first to face the new compensation claims system in which referral fees are banned and ‘no win, no fee’ arrangements have been curbed.

This month sees the introduction of radical legislative reforms aimed at bringing an end to the perceived compensation culture in accident claims.

Following the Jackson reforms, referral fees can no longer be paid for passing on personal injury cases, while the amount of fees that can be recovered through ‘no win, no fee’ arrangements have been significantly squeezed.

With the latest official figures from 2011 showing an estimated 203,950 casualties annually in the UK as a result of road accidents, the reforms could have a dramatic impact on drivers, cyclists and pedestrians.

Primarily, the reforms mean that the general damages paid out will rise by 10%, while the cap for claims in low-value road traffic accidents has been increased from £10,000 to £50,000.

At the same time, legal representatives will no longer be able to recover success fees and after-the-event insurance from the other party.

There will also be a ban on referral fees and exchange of data between insurers, accident management companies and law firms.

The notion of the Jackson reforms were first drawn up three years ago when Lord Justice Jackson found huge rises in civil litigation costs in England and Wales in recent years.

With the annual economic welfare cost of reported road accidents estimated to be around £15.6bn, according to 2011 figures, the reforms are expected to save millions of pounds every year throughout the compensation claims process.
