In an emergency hearing yesterday at the Jefferson County Courthouse
in Colorado, Judge Charles Hoppin ruled that Bob Enyart, a Denver talk
show host, could indeed appear on ABC's "Politically Incorrect" program.
Intervention, a private company that provides probation services for
Jefferson County, filed a motion
to the Court a few weeks ago requesting that the Court consider
preventing Enyart from appearing on "Politically Incorrect."
Intervention's concern was that Enyart, who was convicted of child abuse
for spanking his stepson, would speak about spanking on the ABC program
and gain "support from a segment of the population."

However, after the judge's decision yesterday, Cheryl Marshall, a
spokesperson for Intervention, said her organization accepted the
Court's decision.
"We're comfortable with any decision the judge makes," Marshall said.
"All Intervention's intentions were was to bring it to the attention of
the Court with our recommendation and let the Court make the decision."

Marshall added that Intervention did not plan to pursue the issue any
further.
Although victorious in the hearing, Enyart still must register with
the national child abuse registry because of his conviction. However,
Enyart said he would not be deterred from his objectives simply because
of his conviction.

"I wear that conviction as a badge of honor," said Enyart. Enyart
explained it was just a "bureaucratic oversight" that a conviction like
this hasn't yet happened to other parents who spank their children.
Commenting on Judge Hoppin's decision, Enyart said it was just a
"random event in a mindless system." Though he's happy with the
decision, his cynicism has led him to believe it wasn't true justice
that had prevailed in the situation.
"Even a broken clock is right twice a day," he said.
Randy Canney, an attorney working on the case for Enyart in
cooperation with the American Civil Liberties Union, wasn't nearly as
critical as Enyart regarding the judge's decision.
Speaking of Judge Hoppin, Canney said, "The judge here is a real
reasonable judge who has had a lot of experience practicing before he
got on a bench. He tends to do the right thing most of the time."

Canney told WorldNetDaily that even the District Attorney's office,
who had filed a motion similar to Intervention's motion, had reversed
their opinion of the case after reviewing the facts. The only provision
the DA had regarding Enyart's appearance on "Politically Incorrect" was
that Enyart not mention his stepson's name since he is a juvenile in the
case. The Court granted this provision, and Enyart said he is willing to
comply with it.
Enyart will be traveling to Los Angeles today for "Politically
Incorrect." He told WorldNetDaily he plans to talk about his case on the
show. Spanking is also on the show's agenda which will air on Friday.
Enyart had earlier received national attention in February when he
purchased O.J. Simpson memorabilia, burning them before the Los Angeles
courthouse. Enyart, along with his government watchdog website known as
ShadowGov, is also known for his protest
campaign against Clinton and the alleged Broaddrick rape.
