On Friday, Oct. 14, a communist judge in Salem, Ore., ruled that it was “unfair,” and therefore unconstitutional, for voters to express their will on the subject of land-use planning. The reason? It could result in an unequal outcome.
Our Constitution insures, therefore, not equal opportunity, but equal outcomes. Communists believe that all property either belongs to – or should belong to – the state. We as citizens are only wards of that state. The state’s primary responsibility is to divide up the pie into equal pieces and dole them out to the rest of us. The end result, as the collapse of the USSR showed, is no pie left to divide.
Last year, Oregon voters decided to uphold private property rights because they felt the “takings” through land-use regulations had become excessive. People who had bought property 20, 30 or 40 years ago found they could no longer build their retirement home or subdivide their family farm for retirement income. All they could do was pay property taxes.
Measure 37 was passed by over 60 percent of the state’s voters. It allowed cities and counties to continue to prohibit development through land-use planning – but said they would have to pay the owner for the lost value of his or her land. Barring that – development could proceed.
The state’s pieless pie-splitters went apoplectic. The Legislature declined to intervene (perhaps because its members are elected?). The left’s solution? It’s time to go judge-shopping.
Oregon has a system of county courts (known as circuits), and the people who didn’t own the pie, but nevertheless believed it was their pie to divide up, found Marion County Circuit Court Judge Mary James to hear the case. Perhaps they checked out her 2004 re-election webpage, where visitors are assured that the nonpartisan (Democratic) appointee – should she be elected – will “ensure justice for our community because she is a committed community leader.” There is no discussion of the law on her webpage. In fact, there is no discussion of “justice.” Details – they’re so divisive.
Not only are judges like Mary James an affront to the separation of powers and the voice of the people, they have twisted the wording of the constitution to mean precisely the opposite of what it actually says. And it is important for the rest of us to understand that the left in Oregon – and America – has no problem with this. That is because the left in America is communist. The left of today is not aiming for a few small changes in our way of life. They want to make America into the USSR II, the sequel. And if they ever regain the levers of legislative and executive power, they will. Mary James and her friends in the courthouse will make sure of that.
