A flyer advising Republicans to cast their election ballots Nov. 4 – and Democrats on Nov. 5 – has been distributed throughout several Hampton Roads communities in Virginia.
The notice is dated Oct. 24 and features a Virginia State Board of Elections logo and state seal, the Virginian-Pilot reported.
It warns voters that a large turnout could impact elections and states, "An emergency session of the General Assembly has adopted the follwing (sic) emergency regulations to ease the load on local electorial (sic) precincts and ensure a fair electorial process."

Republicans, and independent voters supporting Republicans, are urged to vote on Election Day "as procribed (sic) by law." However, Democratic Party supporters are told to cast their ballots on the following day – after the election has concluded.
The phony notice concludes: "We are sorry for any inconvenience this may cause but felt this was the only way to ensure fairness to the complete electorial process."

The Virginia-Pilot informed readers, "No emergency action has been taken by the General Assembly. It is not in session and lacks the authority to change the date of a federal election."
State Board of Election officials say they had nothing to do with distribution of the flyer.

"It's not even on our letterhead; they just copied the logo from our website," agency staffer Ryan Enright told the newspaper.
State police are now investigating to determine whether it is a possible case of voter intimidation.
According to the report, it is a Class 1 misdemeanor to purposely mislead voters with false information about registration status or dates, times or places of precincts and polling places.
