One of three high-profile lawyers defending a father and son who conducted an undercover counter-terrorism investigation of the Council on American-Islamic Relations was a guest yesterday on the nationally syndicated Steve Malzberg radio show.

Daniel Horowitz, a frequent TV legal analyst who represented talk-radio host Michael Savage in his lawsuit against CAIR, told Malzberg why the FBI wants to see the smoking-gun evidence against the Muslim group gathered in the probe and why the mainstream media is virtually ignoring the case.

CAIR filed the lawsuit against former Air Force special agent P. David Gaubatz and his son, Chris Gaubatz, claiming they stole sensitive material from the group’s Washington office under false pretenses during a daring probe in which the younger Gabatz posed as a Muslim intern.

But the Gaubatz’s lawyers have filed a motion to dismiss the case, contending CAIR has no claim because it does not legally exist.

A federal judge in Washington issued a restraining order Nov. 3 barring the Gaubtazes from further use or publication of the material – 12,000 pages of documents along with audio and video recordings – and demanding that they return it to the Muslim group’s lawyers. But the FBI stepped into the case Nov. 23 with a warrant to examine the papers and recordings.

The material has been published in the book “Muslim Mafia: Inside the Secret Underworld That’s Conspiring to Islamize America,” co-authored by David Gaubatz with “Infiltration” author Paul Sperry. The book asserts CAIR is acting as a front for a conspiracy of the Muslim Brotherhood – the parent of al-Qaida and Hamas – to infiltrate the U.S. and help pave the way for Saudi-style Islamic law to rule the nation.

Horowitz is working with famed New York City First Amendment lawyer Martin Garbus and Washington, D.C., advocate Bernard Grimm, a regular commentator on the Fox News Channel, CNN and Court TV. Garbus, who has represented the likes of Ronald Reagan, Nelson Mandela and Andrei Sakharov, has appeared before the U.S. Supreme Court along with trial and appellate courts in more than 100 cases, including Daniel Ellsberg’s battle over the Pentagon Papers during the Vietnam War.
