WASHINGTON – "It's inconceivable to me that the American people will permit confirmation to the U.S. Supreme Court of a person who thinks it's OK to ban books," says the organizer of a campaign to block Elena Kagan's nomination.

Joseph Farah, editor and chief executive officer of WND and the force behind the "Stop Kagan Campaign," said Kagan takes just such an anti-First-Amendment position. He says time is running out for Americans to stand up and flood the U.S. Senate with letters to stop Kagan's confirmation.

"Do you want a book banner on the Supreme Court?" he questioned.

As solicitor general, Kagan defended before the Supreme Court a campaign-finance law that could ban books and would ban pamphlets that would promote federal political candidacies or oppose them. While Kagan pointed out the law had never been applied to books, she acknowledged her support for the provision to consider such advocacy books as campaign contributions.

The "Stop Kagan Campaign" is an effort that provides Americans the opportunity to send a letter to every U.S. senator opposing the nomination, delivered by Federal Express, for a price of $24.95 – less than the cost of first-class postage alone.

So far, the campaign has delivered 50,000 letters to the Senate – but Farah thinks it will take 1 million to turn the heads of politically vulnerable senators.

"The senators need to hear from the American people in a big way," says Farah. "They need to understand this is going to be an election issue in their states. They need to know we mean business."

The case against Kagan is building with every confirmation hearing, said Farah. Of particular note has been Kagan's vehement protests of U.S. military recruiting on Harvard University's campus because of Congress' "don't ask, don't tell" policy regarding service by homosexuals.

Her acceptance of $20 million on behalf of Harvard from Saudi Arabia, a nation that expressly forbids homosexuality and freedom of religion, was also noted.

Kagan is also an advocate for the court to use foreign law in deciding the constitutionality of cases before it.

"Make no mistake about it," says Farah. "Kagan is a flame-throwing radical who believes the Constitution is a 'living document' – one whose meaning changes over time, a document whose words can be reinterpreted through the eyes of elitists like her to legislate from the bench."

"Kagan is a radical antimilitary and proabortion zealot," said Farah. "This selection by Barack Obama reveals once again his extremist agenda of leaving America undefended, elevating alternative lifestyles to sainthood and exterminating the most innocent human life with reckless abandon and persecuting anyone who tried to stand in the way. In a nutshell, that's who Elena Kagan is."

Farah's goal is to inundate senators with thousands of letters calling for her rejection for a lifelong appointment to the U.S. Supreme Court.

The letter campaign is based on previously successful efforts in which nearly 10 million "pink slips" were delivered to members of Congress opposing nationalization of health care, cap-and-trade legislation, hate-crimes laws and other bills, as well as the current campaign to stop amnesty in the U.S. Senate.

The "stop Kagan" campaign allows any American citizen to generate 100 individually addressed letters to every U.S. senator, each including the name of the sender and all delivered by FedEx for the low price of just $24.95. That comes out to less than the cost of snail-mailing the 100 letters yourself.

The letter to the senators reads:

"In a few months, the American people will have a chance to speak at the polls again. Almost every analyst and every public-opinion survey suggests the electorate is angry about the direction of the country. I strongly urge you not to show contempt for the will of the people and the Constitution by confirming the Supreme Court nomination of Elena Kagan.

"Kagan is not what Americans want and she is not what the country needs.

"At a time when federal central control is strangling the American economy, she calls for more regulatory authority not just in Washington, but for the president himself.

"At a time when American security is facing internal and external threats and our nation is still engaged in two foreign wars simultaneously, she advocates banning military recruitment on campuses because of her compulsion to see open homosexual behavior flaunted in the ranks.

"At a time when Americans have been stripped of their ability to write their own laws protecting the lives of the unborn, she advocates the creation of task forces to investigate and prosecute peaceful pro-life activities.

"At a time when Americans are recognizing the unique blessings of their Constitution, she advocates the consideration of foreign laws in shaping Supreme Court rulings.

"For all of these reasons and more we will surely learn about in the days ahead, please reject the nomination of Elena Kagan."
