Why is Obamacare, via its mandate to buy insurance, not illegal under the 13th Amendment? It is the federal government forcing people to "work" in finding an insurance policy – to take an "economically productive action for another, without compensation." Is that not the definition of involuntary servitude?
In fact, for the privilege of being forced to engage in "work" you also have to pay for a policy that you may or may not use – but presumably is enriching the insurer via the government forcing all people to be customers, as opposed to being compensated for the "work" performed. Whether it's "a little bit of involuntary servitude" or not shouldn't matter – because once you let the genie out of that bottle, what else can the government force you to "work" on without compensation?
