Harry Reid knows he would lose a court case against Bundy. If Bundy gets a decent attorney like Gerry Spence, he may very well make the case of his right to use the grazing land under the law of Prescriptive Easement by Adverse Possession.
That is why Dingy Harry and the BLM tried to take Bundy by armed force, rather than in the courts.
