(USA TODAY) The 2nd Circuit U.S. Court of Appeals denied New England Patriots quarterback Tom Brady and the NFL Players Association’s appeal for an en banc rehearing in the ongoing Deflategate case.

As a result, Brady’s four-game suspension stands with the start of the regular season just nine weeks away.

“Appellant, Michelle McGuirk, filed a petition for panel rehearing, or, in the alternative, for rehearing en banc,” clerk Catherine O’Hagan Wolfe wrote Wednesday in the decision. “The panel that determined the appeal has considered the request for panel rehearing, and the active members of the Court have considered the request for rehearing en banc.
