MS-13 gang member charged in NYC murder

The 26-year-old man arrested Monday in connection with a fatal shooting on a New York City subway platform is a member of a Central American MS-13 gang.

Ramiro Gutierrez is believed to be one of the MS-13 members who were arrested by ICE in December, pointed out the Legal Insurrection blog.

Gutierrez was free on $2,500 bail awaiting trial when he allegedly committed the murder Sunday.

The New York Times reported Monday it was the first killing on the subway in more than a year. Chief of Detectives Dermot Shea confirmed the gunman is a known MS-13 gang member.

Shea didn't name him, but the Times reported a law enforcement official who spoke on the condition of anonymity said Gutierrez and 11 others were charged in December by the Queens district attorney.

They were charged with conspiracy and attempted murder along with drug and weapons charges.

Conspiracy to kill

An ICE press release in December mentions Gutierrez and gives details of the arrest.

ICE said the 12 defendants are alleged to have conspired to kill two people, a rival member of the Latin Kings and a former member of MS-13.

Gutierrez also was among the members charged in the third indictment with plotting a home invasion in the Kew Garden Hill neighborhood of Queens.

Legal Insurrection noted Trump has been mocked by Democrats for calling MS-13 a threat.
