Islamist suspect in murder case sent to mental health facility gets pass, then flies out of U.S.

An Islamist suspect in a Virginia murder case sent to a mental health facility instead of facing trial and conviction was given a weekend pass, and used it to take a one-way international flight out of the United States.

A published report by Fox5DC confirmed what is known is that Abdulloi Toshpulodzoda was accused of murdering his landlord in 2019.

Investigators arriving at the scene found him covered in blood, but he was found not guilty by reason of insanity and sent to the Northern Virginia Mental Health Institute in 2022.

Just weeks ago a judge reaffirmed orders that he should “not be released from custody and inpatient hospitalization without further order of this court.”

But state law lets a mental health facility grant individual patients passes to leave without an escort, and in 2024 officials allowed him to travel to Washington, D.C., to obtain a passport.

Then in July, on another pass, Toshpulodzoda went to Dulles Airport and boarded a one-way flight to Tajikistan via Istanbul, the report said.

Prosecutors had opposed the release because it was outside of court decisions, but they actually played no role in decisions at the facility.

They then filed a motion asking for a warrant for his arrest should he return to the U.S.

“Abdulloi Toshpulodzoda was found by clinicians to be insane at the time he killed Mohammad Hemmatian – a legal finding that means the Commonwealth would be unable to secure a conviction at trial,” said the Fairfax County Commonwealth Attorney’s office in a prepared statement.

“Following that 2022 finding, prosecutors have opposed his release at annual review hearings, including in June of this year, where a judge ordered that he continue to be confined in a state behavioral health facility. A bench warrant was issued immediately following notice that he had escaped custody, so if he enters the U.S., he will be arrested and brought to Virginia.”

Officials at the Virginia Department of Behavioral Health and Developmental Services said they couldn’t discuss the case because of privacy laws.

Officials did admit that the law allows “privileges” for patients “as part of treatment,” the report said.

At the Gateway Pundit was the comment, “This is the latest outrageous failure of Virginia’s Democrat-run mental health and criminal justice system under Governor Abigail Spanberger.”

“According to court records cited by FOX 5 DC, Toshpulodzoda traveled to Washington Dulles International Airport on July 6 and boarded a one-way Turkish Airlines flight to Tajikistan through Istanbul,” the report said.

It continued, “Toshpulodzoda, described in records as an illegal immigrant from Tajikistan, is now back in his home country. American taxpayers funded his housing and treatment for years after he killed a man in cold blood.”
